This Act seeks to amend the current state law regarding the display of license plates to allow for the temporary covering of license plates on vehicles that are parked.
(b) Amendment
2.08.07 is hereby amended to read as follows:
"A person is guilty of a License Plate violation when they:
Have plates attached to their motor vehicle that aren't issued to that vehicle; or
Have a license plate affixed to a vehicle that is blank;
Do not show a valid back license plate;
Do not have one plate attached to the vehicle.
Exception:
These violations shall not apply when the vehicle is parked, and the license plate is temporarily covered or obscured, provided that the plate is visible when the vehicle is in motion on public roads.
Any violation under this section shall be prosecuted as an infraction."
(c) Severability
If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end, the provisions of this Act are severable.
(d) This bill allows citizens to cover their vehicle's license plates when parked, addressing privacy concerns, protection against unauthorized plate data collection, and security of personal information, while maintaining compliance with traffic laws by requiring plates to be visible when the vehicle is in motion.
SECTION 5. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2024 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
